Article Fifth of the 1818 constitution was also the judicial article.67 In the U.S. Constitution, the judicial power, that is, the power to construe the law and apply it to individual cases, is discussed in Article III. The judicial power of the state shall be vested in a supreme court, an appellate court, a superior court, and such lower courts as the general assembly shall, from time to time, ordain and establish.
